1. Agreement to Terms

By accessing or using ProgressNest ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms constitute a legally binding agreement between you and ProgressNest, operated by Deepak Toora, United Kingdom.

2. Description of Service

ProgressNest is a subscription-based web application that allows parents and guardians to track their children's educational progress, log milestones, set learning goals, and receive AI-powered insights and progress reports. The Service is intended for personal, non-commercial use by parents and guardians.

3. Eligibility

You must be at least 18 years old to create an account. By using the Service, you confirm that you are the parent or legal guardian of any child whose data you enter into the platform. You are responsible for ensuring that the data you enter is accurate and that you have the right to share it.

4. Subscription Plans and Payment

ProgressNest offers the following plans:

Payments are processed by Stripe. Subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time from the Billing page. No refunds are provided for partial billing periods, except where required by UK consumer law.

5. Free Trial

New accounts receive a 14-day free trial of Premium features. No payment is required during the trial. At the end of the trial, your account will automatically revert to the Free plan unless you have subscribed to a paid plan.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Enter data about children who are not your own or for whom you do not have parental/guardian responsibility
  • Attempt to reverse-engineer, hack, or disrupt the Service
  • Share your account credentials with others
  • Use the Service to store or transmit any harmful, offensive, or illegal content

7. AI-Generated Content

The AI Insights feature generates educational suggestions based on the data you enter. These insights are for informational purposes only and do not constitute professional educational, medical, or psychological advice. Always consult qualified professionals for specific educational needs.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the processing of your data as described in the Privacy Policy.

9. Intellectual Property

The ProgressNest platform, including its design, code, and content, is owned by ProgressNest and protected by UK intellectual property law. You retain ownership of the data you enter (milestones, goals, notes). You grant us a limited licence to process that data solely to provide the Service to you.

10. Limitation of Liability

To the maximum extent permitted by UK law, ProgressNest shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid in the 12 months preceding the claim. Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence.

11. Termination

You may delete your account at any time via Settings → Account → Delete Account. We may suspend or terminate your account if you breach these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
